THC in Arkansas

Arkansas banned hemp-derived THC products following a June 2025 8th Circuit Court of Appeals ruling that upheld Act 629 of 2023. The ban prohibits synthetic cannabinoids derived from hemp such as delta-8 and delta-10 THC, as well as hemp-derived delta-9 THC products with more than 0.3% THC. The law was temporarily blocked by a federal injunction in 2023 but became enforceable in 2025 after the appeals court ruled that states have the authority to regulate hemp products more strictly than federal law. Retailers have been instructed to remove all THC products from shelves, with enforcement beginning immediately. Only non-intoxicating CBD and CBG products remain legal.
