THC in Colorado

Hemp-derived THC products including delta-8 are illegal in Colorado following regulatory actions by the Department of Public Health and Environment and Marijuana Enforcement Division. In May 2021, regulators banned the chemical modification or conversion of naturally occurring cannabinoids from industrial hemp, effectively prohibiting synthetic delta-8 THC production. Senate Bill 22-205 (2022) empowered state agencies to prohibit intoxicating hemp-derived products, followed by Senate Bill 23-271 (2023) that created safe harbor provisions allowing Colorado manufacturers to produce prohibited products for export to legal states while maintaining the in-state ban. The state considers chemically converted cannabinoids as synthetic controlled substances, distinct from naturally occurring compounds, and maintains strict separation between regulated marijuana and hemp markets.
