THC in Georgia

Georgia legalized hemp-derived cannabinoids under Senate Bill 494, signed by Governor Brian Kemp in April 2024 and effective July 1, 2024. The law maintains legality for most hemp-derived cannabinoids under 0.3% delta-9 THC but introduces significant regulations: 21+ age restrictions for all consumable hemp products, mandatory licensing and testing requirements, prohibition of hemp flower and leaf sales (processed extracts remain legal), ban on food products infused with hemp cannabinoids, and requirements for child-resistant packaging and proper labeling. Products must include certificates of analysis updated annually from licensed laboratories. The law specifically protects "consumable hemp products" and rejected attempts to group delta-8, delta-10, and HHC under the same 0.3% limit as delta-9 THC. Retailers must verify age and cannot advertise products as medical treatments.
