THC in Hawaii

Hawaii severely restricts hemp-derived THC products through comprehensive regulations under the Hawaii Department of Health. While HB 2689 (2020) initially legalized hemp products, subsequent administrative rules effective December 2024 prohibit hemp products with delta-9 THC above 0.3%, ban gummies entirely, prohibit foods and beverages containing hemp derivatives, ban inhalable hemp products including vapes and flower material, and restrict most forms of hemp-derived THC products. Only specific forms are allowed: tablets, capsules, powders, softgels, gelcaps, and liquid forms, and only when intended as dietary supplements with proper testing and labeling. The state passed legislation in 2025 requiring all hemp retailers and distributors to register starting January 1, 2026, with expanded enforcement powers for seizing non-compliant products and fining businesses.
