THC in Idaho

Idaho completely prohibits hemp-derived THC products and maintains some of the strictest hemp laws in the nation. House Bill 126, enacted in 2021, legalized hemp cultivation but explicitly prohibited all THC isomers including delta-8, delta-9, and delta-10 THC. The state requires hemp products to contain 0.0% THC (zero tolerance policy), making it illegal to sell any hemp product with detectable THC levels. Even CBD products must be THC-free and derived only from specific parts of the hemp plant (mature stalks, fiber, seeds). Licensed handlers must dilute products to 0% THC during processing, and any products exceeding this limit are subject to law enforcement action. Idaho's 2025 legislative session saw efforts to make cannabis laws even more draconian, including mandatory minimum fines for possession.
