Hemp-derived THC legality in Massachusetts is complex and enforcement varies. Bill H.4001 (2018) aligned state law with federal hemp definitions, technically legalizing hemp-derived delta-9 THC products under 0.3%. However, the Massachusetts Department of Agricultural Resources (MDAR) issued a 2022 memo declaring delta-8 THC illegal as a "synthetic" cannabinoid, regardless of hemp derivation. Hemp-derived delta-9 products remain technically legal, but many other hemp-derived THC isomers exist in a gray area. Products can be found in smoke shops, CBD stores, and convenience stores, but enforcement is inconsistent. Age restrictions typically follow standard hemp product guidelines (21+), but there are no specific licensing requirements for retailers selling compliant hemp-derived products.
