THC in Minnesota

Minnesota has established a structured regulatory framework for hemp-derived THC products since 2022 legislation (HF 3595) that legalized and regulated hemp-derived cannabinoids. Hemp-derived edible products are limited to 5 milligrams of total THC per serving and 50 milligrams per container, with a 21+ age requirement for purchase. All businesses selling hemp-derived cannabinoid products must register with the Office of Cannabis Management (OCM), and only edibles and beverages are permitted – no inhalable products. The law explicitly allows Delta-8 and Delta-9 THC from hemp but prohibits synthetic cannabinoids like THC-O, THC-P, and HHC. Minnesota legalized recreational marijuana in August 2023, creating parallel markets for both hemp-derived products (lower potency) and cannabis products (higher potency). Retailers must display products behind counters or in locked cases, and comprehensive testing and labeling requirements are enforced.
