THC in Montana

Montana severely restricts hemp-derived THC products through HB 49, signed into law by Governor Gianforte in 2025, which sets extremely low THC limits of 0.5mg per serving and 2mg per package for hemp products. The state operates its hemp program under USDA approval as of January 2023, but the restrictive serving limits effectively make most commercial hemp-derived THC products non-viable for retail sale. Montana also classifies delta-8 and other THC isomers as controlled substances under its 2019 amendments to the Controlled Substances Act. Age restrictions and licensing requirements follow standard hemp regulations, but the practical effect of the serving limits is a de facto ban on meaningful hemp-derived THC retail products.
