THC in Nebraska

Nebraska currently allows hemp-derived THC products under the federal 2018 Farm Bill and the Nebraska Hemp Farming Act of 2019, which legalized hemp and hemp derivatives containing no more than 0.3% delta-9 THC. However, the state saw significant legislative battles in 2025 with LB 316, which would have prohibited most consumable hemp and THC products by redefining hemp to include "total THC" rather than just delta-9 THC, and limiting processed hemp to 0.3% THC total weight basis or 10 milligrams per package. The bill failed to advance in May 2025 and was delayed until at least 2026, keeping current hemp products legal. The state legalized medical marijuana in November 2024, with licensing beginning October 2025, but ongoing political opposition from the Attorney General's office continues to threaten the hemp industry through potential future legislation.
