THC in New Jersey

Hemp-derived THC products are currently legal in New Jersey under the New Jersey Hemp Program established by Bill A5322 (2019), but comprehensive regulation is pending. Products can be sold through various retail outlets including smoke shops, convenience stores, and CBD stores without specific licensing requirements. However, the state Cannabis Regulatory Commission is actively developing regulations for hemp-derived THC products, and Assembly Bill No. 1890 (pre-filed in January 2024) proposes a registration process for manufacturing and selling hemp-derived cannabinoids. Some municipalities have enacted local bans or restrictions. Age restrictions typically follow adult-use cannabis guidelines (21+), but enforcement varies. The regulatory landscape is expected to change significantly in 2025-2026 as the state implements more comprehensive oversight of the hemp-derived THC market.
