THC in New Mexico

Hemp-derived THC products are legal in New Mexico, with the state's hemp laws aligning with the 2018 Farm Bill. The New Mexico Hemp Manufacturing Act defines hemp as cannabis with delta-9 THC concentration of not more than 0.3% on a dry weight basis, including all derivatives, extracts, and cannabinoids. However, the New Mexico Environment Department issued emergency rules banning the manufacture of synthetic cannabinoids like delta-8 THC that are chemically converted from naturally occurring compounds. Products must be 21+ for adult-use hemp products containing more than 0.5 milligrams of THC. The state has both recreational marijuana and hemp-derived THC markets operating simultaneously, though regulators prefer consumers use the regulated cannabis market rather than unregulated hemp derivatives.
