THC in North Dakota

North Dakota explicitly prohibits Delta-8 THC and other intoxicating hemp-derived cannabinoids under state law. House Bill 1045 (2021) amended the state's hemp legislation to specifically ban Delta-8 THC, Delta-10 THC, and other psychoactive hemp derivatives as controlled substances. North Dakota law requires all hemp products to contain less than 0.3% "Total THC" (calculated as THCa x 0.877 + Delta-9 THC), effectively prohibiting most intoxicating hemp products. Only non-intoxicating cannabinoids like CBD, CBG, and CBN are permitted, provided they contain no synthetic cannabinoids. The North Dakota Department of Agriculture oversees hemp regulation and requires certificates of analysis for all hemp products sold in the state. THCa vape products are also prohibited under the state's ban on inhalants.
