THC in Ohio

Hemp-derived THC products including Delta-8, Delta-9, and other cannabinoids are currently legal in Ohio under Senate Bill 57 (2019), which legalized hemp and its derivatives containing less than 0.3% Delta-9 THC. However, Ohio Senate unanimously passed Senate Bill 86 in May 2025, which would restrict all "intoxicating hemp products" (defined as products with more than 2mg Delta-9 THC or 0.5mg of other THC variants per package) to licensed marijuana dispensaries only, with a 21+ age requirement and 10% tax. Governor Mike DeWine has actively pushed for these restrictions citing safety concerns and youth access. The bill is currently pending in the Ohio House. Until this legislation is enacted, hemp-derived THC products remain widely available in gas stations, convenience stores, and online without age restrictions or testing requirements.
