THC in Oklahoma

Hemp-derived THC products remain legal in Oklahoma for those 21 and older, but the regulatory environment is increasingly scrutinized. Governor Kevin Stitt issued a letter in April 2025 directing multiple state agencies to crack down on unregulated psychoactive hemp-derived products, citing public health and safety concerns. While no new legislation has been enacted to restrict delta-8 THC as of September 2025, the increased enforcement attention indicates potential future changes. Products must be derived from hemp containing less than 0.3% delta-9 THC by dry weight. The state distinguishes between hemp-derived and marijuana-derived THC, with the former being legal and the latter requiring medical marijuana licensing.
