THC in South Carolina
Regulation summary
South Carolina has multiple conflicting positions on hemp-derived THC. While the state passed House Bill 3449 in 2019 legalizing all hemp derivatives with less than 0.3% delta-9 THC, the Attorney General's Office issued a non-binding opinion in 2021 stating that delta-8 THC is illegal under the Hemp Farming Act. This has created enforcement confusion with some law enforcement agencies conducting raids while others treat products as legal. Multiple bills are pending in the 2025 legislature: Senate Bill 137 would regulate hemp-derived cannabinoids with licensing requirements, age restrictions of 18+, testing mandates, and $500 producer/$250 retailer licensing fees; House Bill 3935 would create similar regulations for "hemp-derived consumables" with a 2% excise tax; and House Bill 4004 would specifically regulate hemp-derived beverages with 21+ age restrictions and 10mg THC serving limits.
