THC in South Dakota

South Dakota prohibits most intoxicating hemp-derived THC products under legislation signed by Governor Kristi Noem in March 2024, effective July 1, 2024. The law specifically bans the practice of converting naturally occurring cannabinoids like CBD into Delta-8 THC, Delta-10 THC, or any other THC isomer, analog, or derivative through chemical synthesis. The legislation explicitly prohibits THC-O, THC-O-acetate, HHC (hexahydrocannabinol), and THCP (tetrahydrocannabiphorol), along with other synthetic cannabinoids. While the law doesn't ban naturally occurring hemp-derived THC in trace amounts, the prohibition on synthetic conversion effectively eliminates the commercial hemp-derived THC market, since most Delta-8 and similar products are chemically converted from CBD rather than naturally extracted.
