THC in Texas

Hemp-derived THC products remain legal following Governor Abbott's veto of Senate Bill 3 and subsequent Executive Order GA-56 issued in September 2025. The executive order implements regulations including a ban on sales to those under 21 (enforced by TABC starting October 1, 2025), enhanced testing requirements to measure total delta-9 THC including THCA conversion, revised labeling and health warnings, and increased licensing fees. Vapes containing THC were banned under Senate Bill 2024 effective September 1, 2025, with penalties up to one year in jail and $4,000 in fines. The order stops short of banning delta-8 and synthetic cannabinoids that Lieutenant Governor Patrick had sought to prohibit, instead focusing on regulation rather than prohibition.
