Regulation summary
All forms of hemp-derived THC, including delta-8, delta-9, and delta-10, are illegal in Utah under Chapter 37 of the Utah Controlled Substances Act. The state classifies all tetrahydrocannabinols and their isomers as Schedule I controlled substances regardless of source, making no distinction between hemp and marijuana-derived THC. House Bill 227, signed in March 2023, further prohibited "artificially derived cannabinoids" in hemp products, making them adulterated and illegal. Utah maintains some of the strictest cannabis laws in the nation, with only a limited medical marijuana program available to qualified patients. The state's industrial hemp program is limited to non-intoxicating uses, and possession or sale of delta-8 THC can result in misdemeanor or felony charges depending on quantity and intent.
