THC in Washington

Washington state effectively prohibits hemp-derived THC for retail sale through SB 5367, passed in 2023, which requires that only licensed cannabis retailers can sell products with any detectable levels of THC, including hemp-derived THC. This makes Washington one of the strictest states regarding hemp products. The Washington State Liquor and Cannabis Board (WSLCB) issued policy statements in 2021 and has continued enforcement through 2025, treating hemp-derived products with any THC content as regulated cannabis that must be sold through the state's licensed dispensary system. Products containing hemp-derived delta-8, delta-9, or other THC compounds are prohibited for sale in general retail, with violations resulting in fines up to $2,500 and product seizure for first violations, and potential license suspension for repeat violations.
