THC in West Virginia

West Virginia currently allows hemp-derived THC products under the Select Plant-Based Derivatives Regulation Act, which defines "hemp-derived cannabinoid" as naturally occurring non-synthetic substances including delta-9 THC with no more than 0.3% concentration. However, Senate Bill 546 is pending that would classify delta-8, delta-10, and other psychoactive hemp-derived cannabinoids as Schedule I controlled substances, effectively banning them. The state requires naturally occurring, non-synthetic substances only - synthetically derived products are prohibited. The Alcohol Beverage Control Administration Commissioner shares regulatory authority with the Department of Agriculture. Current law excludes hemp THC from being considered a controlled substance, but this may change if SB 546 is enacted.
