THC in Wisconsin

Wisconsin currently allows hemp-derived THC products through what lawmakers call a "loophole" in the state's hemp laws, with products containing less than 0.3% delta-9 THC being legal under the 2017 Industrial Hemp Act and federal law. However, Republican lawmakers proposed legislation in September 2025 to ban hemp-derived THC products entirely, which would redefine hemp to include "total THC" (including THCA) and exclude hemp-derived cannabinoid products intended for human consumption if they have intoxicating effects. The proposed bill would effectively ban beverages, gummies, vapes, and other hemp-derived THC products currently sold legally at retail stores, gas stations, and bars. Wisconsin remains one of the few states with no legal cannabis access, making hemp-derived products popular alternatives.
